Discussion of the Tri-Partite Relationship and Ethical Issues that arise because of the relationship between an insurance carrier, its insured, and defense counsel retained to defend a claim against the insured, with a focus on the duty of loyalty, duty to exercise independent judgment, conflicts of interest, and duty of confidentiality.  The presentation also includes discussion of relevant disciplinary rules and ethics opinions.
